These Terms and Conditions ("Terms") govern all purchases and use of products and services offered through soundfingers.com ("the Site"). By placing an order or creating an account, you agree to these Terms in their entirety. Please read them carefully.

1. Seller Information

SoundFingers is operated by Mathieu Rahm, micro-entrepreneur registered in France (SIRET: 83876902400012).

2. Products

SoundFingers offers digital audio software plugins ("Plugins") designed for professional and home music production environments. All products are delivered electronically — no physical goods are shipped.

Detailed specifications, system requirements (supported DAWs, OS versions), and format information (VST3, AU) are provided on each product page. You are solely responsible for verifying compatibility with your system before purchasing. SoundFingers does not guarantee compatibility with all configurations.

3. Prices

All prices are displayed in euros (EUR, €) and are final, inclusive of all applicable taxes.

SoundFingers operates under the French franchise en base de TVA regime (art. 293 B du CGI) and is not subject to VAT.

Prices are subject to change without notice. The price applicable to your order is the price displayed at the time of checkout confirmation.

Promotional prices and discount codes are valid only during the specified period and cannot be applied retroactively.

4. Payment

We accept the following payment methods:

• Credit/debit card (Visa, Mastercard, American Express) — processed by Stripe
• PayPal

Payment is processed exclusively by our certified payment providers. SoundFingers does not store, access, or transmit card details. All transactions are encrypted (TLS/HTTPS). An order is confirmed only upon successful payment authorization. In the event of payment failure, no order is created and no product is delivered.

5. Order Process & Electronic Delivery

Upon successful payment:

• An order confirmation email is sent to the address provided at checkout.
• A delivery email containing your license credential and download instructions is sent to the same address, typically within minutes.
• Downloads are accessible at any time via your account dashboard: soundfingers.com/account/downloads

Delivery is entirely electronic and occurs immediately upon payment confirmation. If you have not received your delivery email within 30 minutes, please check your spam folder before contacting us at contact@soundfingers.com with your order number.

6. License

Each purchase grants a personal, non-exclusive, non-transferable license to use the purchased software, governed by our End User License Agreement (EULA), incorporated into these Terms by reference. Using the Software constitutes acceptance of the EULA.

7. Right of Withdrawal — EU Consumers

Under EU Directive 2011/83/EU, consumers in the European Union ordinarily have 14 days to withdraw from a distance purchase without giving reasons.

Digital content exception (Art. 16(m)): For digital content not supplied on a physical medium, the right of withdrawal does not apply once delivery has begun, provided the consumer has expressly consented to immediate delivery and acknowledged the resulting loss of the withdrawal right.

At checkout, you will be asked to tick a box confirming:

• You request immediate delivery of the digital content, and
• You acknowledge that you waive your right of withdrawal once the download begins.

If you have not yet downloaded or activated your product, you may request cancellation within 14 days of purchase by contacting contact@soundfingers.com before initiating any download.

8. Refund Policy

Given the non-returnable nature of digital software, all sales are final once a product has been downloaded or a license activated.

Exceptions:

Refund requests must be sent to contact@soundfingers.com with your order number and a description of the issue. Eligible refunds are processed within 5 business days to the original payment method.

9. Account

To purchase products and access downloads, you must create an account on soundfingers.com. You are responsible for:

• Providing accurate account information
• Maintaining the confidentiality of your password
• All activity that occurs under your account

If you suspect unauthorized access to your account, notify us immediately at contact@soundfingers.com. SoundFingers is not liable for losses resulting from unauthorized account use where reasonable security precautions were not followed.

10. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, disassemble, or modify the Software
• Redistribute, resell, rent, lend, or sublicense the Software or any license credential
• Share download links or account credentials with third parties
• Circumvent or attempt to circumvent the license activation system
• Use the Software in any way that violates applicable law

Violation of these Terms will result in immediate license termination without refund and may be subject to legal action.

11. Intellectual Property

All Software, audio content, graphics, interface designs, logos, and documentation remain the exclusive intellectual property of Mathieu Rahm. No purchase transfers any intellectual property rights. All rights not expressly granted under the EULA are reserved.

12. Availability & Updates

SoundFingers makes reasonable efforts to keep the Site and downloads available, but does not guarantee uninterrupted access. Scheduled maintenance will be communicated where possible.

Software updates for the purchased major version are provided at no cost. SoundFingers reserves the right to charge for future major version upgrades.

13. Disclaimer of Warranties

To the extent permitted by applicable law, the Software and the Site are provided "as is" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. SoundFingers does not warrant that the Software will meet all requirements or operate without errors on all systems.

14. Limitation of Liability

To the maximum extent permitted by law, SoundFingers shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Software or the Site. Total liability for any order shall not exceed the amount paid for that order.

Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

15. Modifications to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site following a change constitutes acceptance of the revised Terms. For significant changes, we will notify registered users by email.

16. Governing Law & Disputes

These Terms are governed by French law. In the event of a dispute, we encourage you to contact us first at contact@soundfingers.com to seek an amicable resolution. Failing that, disputes shall be submitted to the competent French courts.
